Is there a time limit for personal injury claims?

You usually have three years from the date of the incident to make a personal injury claim formally at court. In some circumstances, it can be three years from the ‘date of knowledge’ – the date your illness or injury was diagnosed or discovered.

There are exceptions to the three-year time limit. For example, if you were under 18 when the personal injury occurred, you have until your 21st birthday to make a claim. Your personal injury solicitor will be able to advise you about this and other exceptions to the three-year rule.

How long do personal injury claims take?

This varies depending on many factors such as the complexity of the injuries sustained by you and whether the Defendant (the person believed to be responsible for the accident) admits liability. Straightforward road accident claims can be settled in as little as 4-6 months.

If the Defendant does not admit liability for the accident, the claim may take longer than if they do admit liability. In the event an agreement cannot be reached with the Defendant as to whether they are responsible or how much the claim is worth, then it may be necessary to go to court.
